Information on meeting EU requirements by Hutmen SA within the scope of:
1. Regulation (EC) No. 1907/2006 of the European Parliament and of the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH),
2. Regulation (EC) No. 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures, amending and repealing Directives 67/548/EEC and 1999/45/EC, and amending Regulation (EC) No 1907/2006
Ad 1.
According to requirements and definitions of this Regulation, Hutmen SA as a manufacturer of products and semi-products of copper and copper alloys is by the definition a DOWNSTREAM USER.
Downstream user: means any natural or legal person established within the Community, other than the manufacturer or the importer, who uses a substance, either on its own or in a preparation, in the course of his industrial or professional activities.
Alloy: means a special kind of a preparation, a mixture consisting of two or more substances (elements), homogenous on a macroscopic scale, so combined that they cannot be readily separated by mechanical means.
Within the Regulation, subject to registration are exclusively SUBSTANCES, whether on their own, in preparations or in articles, present in those articles in quantities totalling over 1 tonne per producer or importer per year.
Relating the above legal parameters to our production scope, we declare that we are not manufacturers and/or importers of any substances used in the product manufacture. In the metallurgical or plastic-working processes, we give a final shape to the externally purchased substances in form of scraps or pure raw materials, optimizing their physicochemical properties to meet requirements of specifications for final products.
In the meaning of the Directive 2006/12/EC of the European Parliament and of the Council of 5 April 2006, wastes (scraps) are not substances, preparations or articles, so they are not subject to registration within the REACH Regulation. Subject to registration by external manufacturers are raw materials only.
Acc. to the Regulation (EC) No. 1907/2006, Hutmen SA is a MANUFACTURER of one article named “Slags, lead-zinc smelting”. According to the obtained transitional period, it was registered in ECHA in November 2010. The product is marketed as artificial aggregate for asphalt-mineral mixtures and surface reinforcements used in road construction and other ground works.

Ad 2.
According to requirements and definitions of this Regulation, metals in form of alloys do not require a label, if they do not present a hazard to human health by inhalation, ingestion or contact with skin or to the aquatic environment in the form in which they are placed on the market. They are only subject to classification.
Summary concerning REACH and CLP
To meet the requirements of the a.m. Regulations for information flow, we have prepared Data Sheets for our offered products and semi-products of copper and copper alloys, and also for our zinc-lead slag (Slags, lead-zinc smelting).
